1. General

Athletic Clean Corp. (hereinafter “AC” or “HC”) employs an Acceptable Use Policy (hereinafter “AUP“) to maintain the integrity and performance of its computer equipment. In a shared web hosting environment, several clients must share limited infrastructure resources. As such, it is important not to use your hosting account in a way that may negatively affect other AC OR HC clients. Our AUP describes what is and is not allowed on our servers. By using any of our services, you agree to comply with our AUP. Failure to comply with the AUP may result in account suspension or termination without prior notice. AC OR HC will remain the sole arbiter in what constitutes a breach of our AUP.

2. Illegal Activities

You may not use any of AC OR HC’s services for illegal purposes. You agree to comply with any applicable local, provincial, federal and international laws, government rules or requirements. You agree you will not be entitled to a refund of any fees paid to AC OR HC if, for any reason, AC OR HC takes corrective action with respect to your improper or illegal use of its services.



AC OR HC reserves the right at all times to disclose any information as AC OR HC deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in AC OR HC’s sole discretion. 3. Spam Policy

AC OR HC has a zero-tolerance spam policy. It is forbidden to send unsolicited mail from or to our servers under any circumstance. Penalties amounting to a minimum of $150.00, plus taxes, can be charged for a first offence, and penalties double for repeat offenders.

11. Unlawful Conduct or Improper Use

You agree not to use AC OR HC systems for any purpose that is unlawful or prohibited by this AUP, and you agree to comply with any applicable local, provincial, federal and international laws, government rules or requirements.

AC OR HC reserves the right to terminate services, in its sole discretion, if you are using the services, in association with spam or morally objectionable activities including, but not limited to:

  1. Activities designed to defame, embarrass, harm, abuse, threaten, slander or harass third parties;
  2. Transmission, distribution or storage of any material in violation of any applicable law or regulation, including Warez and any pirated content or tools;
  3. Transmission, distribution or storage of any material protected by copyright, trademark, trade secret or other intellectual property right without proper authorization, and material that is obscene, defamatory, an invasion of privacy or constitutes an illegal threat, or is otherwise illegal;
  4. Misrepresenting or fraudulently representing products/services;
  5. Impersonating the identity of a third party;
  6. Illegal access to other computers or network (i.e. hacking) and distribution of Internet viruses or similar destructive activities;
  7. Violating Canadian or American export control laws for software or technical information;
  8. Facilitating, aiding, or encouraging any of the above activities, whether using AC OR HC’s network or service by itself or via a third party’s network or service;
  9. Interference with a third party’s use of AC OR HC’s network or service, or ability to connect to the Internet or provide services to Internet users.

12. Adult Content

Explicit or pornographic content, dialogue, be it electronically or otherwise, is strictly forbidden from AC or HC Users. Users must be of legal age, (in Ontario 18), to place orders and use the services within.

13. Violation

AC OR HC will, at its own discretion, determine what action will be taken in case of a violation of the AUP. AC OR HC reserves the right to suspend or terminate any account found to be violating the AUP without notice and without refund of any pre-paid fees. Violation of this AUP could also subject you to criminal or civil liability.

14. Rights reserve

AC OR HC reserves the right to modify this AUP at any time without providing prior notice. You are responsible for all use of the AC OR HC services by yourself, your employees, agents, contractors, invitees and customers, whether such use is with or without your consent.

16. How to Report Abuse

Please contact support@horseyclean.com to report abuse. Please ensure you include as much information as you can to assist our investigations. Complaints will be investigated within 24 hours of receipt and we may follow up to obtain additional information. Unless we require additional information, you will not receive a reply or update from us.

17. Severability

Should any provision of these Terms and Conditions be contrary to law, void, enforceable or illegal for any reason, such provision shall be deemed severable from the Terms and Conditions and shall not affect the validity or the enforceability of the remaining provisions.

18. Applicable Law and Jurisdiction

This Agreement and its interpretation are subject to the laws of the province of Ontario and the laws of Canada applicable therein, without giving effect to any principles of conflicts of laws. The Parties must irrevocably submit all disputes arising out of this Agreement to the courts of the Province of Ontario, including disputes regarding the Agreement’s interpretation and its effects.

Terms and Conditions for EMT/Payments, Services, Electronic Communications, Privacy and Refund Policies

  1. General

SEE IMPORTANT DEFINITIONS IN SECTION 2 BELOW.

  1. These terms and conditions apply to all EMT (electronic money transfer) payments made to HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP.
  2. These terms and conditions also apply to Electronic Communications (whether or not in connection with an EMT payment).
  3. In addition to these terms and conditions, to HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP. apply to your use of any HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP. website. Current copy of this privacy policy may be found http://horseyclean.com/policies
  4. By making an EMT payment to HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP. by requesting Electronic Communication(s), and or by requesting services from HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP. you accept these terms and conditions.
  5. HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP. may amend these terms and conditions at any time by posting the amendment on its website at least 30 days prior to the effective date of change.

  1. Definitions

As used in these terms and conditions:

  1. “HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP, “we,” or “us ” refers collectively to HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP. and all of its divisions and or other divisions.
  2. “You” means you, the customer.
  3. “Service” means any service provided by HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP. and such as Equestrian Equipment Cleaning, Wash Dry and Fold, Repairing, Equipment Polishing, and any other specialty service such as repairs.
  4. “Electronic Communications ” means any electronic billing and payment communications sent by HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP. to you or by you to HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP., such as online access to statements and emails relating to billing or payment, disclosures, notices and other communications regarding your Service (including, without limitation, your billing statements notice of the posting of your electronic billing statements, privacy notices, change-in terms, notifications, and any periodic email communications).
  5. “EMT” or Electronic Money Transfer is any type of email notification payment via online banking.
  6. “Automatic payments” refers to having your bank account register Athletic Clean Corp. as a payee for billing and automatically paid for every order and or service provided to you in your or your team’s account.
  7. Authorization

By sending payment this acts as an acceptance of service. Furthermore

  1. You are representing and warranting to us that you are an authorized user of the bank account and that the associated information entered (account holder name, account number, billing address, etc.) is accurate.
  2. Team Representative Authorization: As a team agent/representative, you are further authorized to collect, on behalf of team member and make one payment to HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP. and make payment in full upon invoicing. This is inclusive of all collective charges for each player.

  4. Charges
  5. For each transaction, in addition to the charge you have authorized, your credit card issuer and network may assess their customary transaction or handling charge, if any.
  1. Confirmation of Payment
  2. By clicking “Schedule” or “Next” you are consenting to receive a one-time confirmation of this payment electronically to the email address you have provided to us.
  3. If you set up automatic payments, then you are consenting for us to charge
  4. All transactions are final. Please see our Refund Policy.
  5. REFUND POLICY

All transactions are final. Transactions  are all made online. Any and all refunds will be provided as a “In-Service” Credit to the client’s Personal or Team Account. Any claim should be made to Athletic Clean Corp.’s Management via email at refunds@athleticclean.com within five (5) business days upon receipt of services.

  1. OUR SERVICES

Please see ‘Our Services’ and/or ‘Services’ page in which you may also request a base price list on each and all of our services or download it by clicking the button at the bottom of the Rates pages. You are invited to also email  support@horseyclean.com with “Price List Please” in the subject line and we will send it to you. All of our price lists are basic prices and upcharges may apply depending on service selection such as water resistant treatment or repairs. Prices are based upon material, material type, construction of garment or item including trim and or decoration, and the time that it would take for us to process the item. All prices are subject to change without prior notice.

  1. Payment for Services

Mark and stain removal is not guaranteed, as some stains and marks in combination with some fabrics may be unserviceable and unable to be removed without possible damage to the function and use, texture or fabric. The process the service provides, although involves a vigorous scrubbing application to all pieces, is there to eliminate the microbial evolution of further contamination over the removal of puck marks, stains and other fabric bonded marking that may be present. You are responsible for payment to process the equipment. Stain removal, whether the stain(s) is removed or not, does not constitute a reason for nonpayment or wherein the equipment is not hygienic and processed. Payment must be made in full for processing of the equipment regardless of any remaining marks.

  1. Service Disclaimer

 We exercise the utmost care in processing articles entrusted to us, and use such processes, which, in our opinion, are best suited to the nature and condition of each individual article. Nevertheless, we cannot assume responsibility for inherent weaknesses of, or defects in materials that are not readily apparent prior to processing. This applies particularly, but not exclusively, aged equipment, helmets past the CSA expiry date (in particular the adhesive on foams), old screening which may result in peeling. Some materials may include suede, leathers silk, satin, vinyl, polyurethane, etc. Responsibility is also disclaimed for trimmings, buckles, beads, buttons, belts, sequins and any type of ornamentation.

In our process we cannot guarantee against color loss or against damage to weak and tender fabrics. Even though no bleaches, harsh surfactants or hot water is used in our process, our work is a vigorous process, as it has to be. to enable an effective result.

  1. Item(s) Processing Consent

 By sending or presenting your Equestrian equipment/team’s equipment or item(s) to Horsey Clean a div. of Athletic Clean Corp. you agree and understand that there is the possibility of unpredictable reactions that may adversely affect the fabric and/or trim and construction of the item(s) presented to Horsey Clean a div. of Athletic Clean Corp. Such unpredictable reactions include but are not limited to being originated from manufacturer defect, unserviceability, misleading or incorrect care label instructions, missing care label instructions, normal wear and tear deterioration, or any source outside of HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP. knowledge prior to processing.

 By leaving or sending your items to HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP., you give HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP., the permission to use whatever it deems necessary to clean your equipment and you will not hold HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP., responsible should there be any problems or damage that occurs because of processing caused by unpredictable reactions.

You also acknowledge that any item left at or sent to HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP., is inventoried by individual and by team if in that setting, by colour zip ties on each piece of equipment and to ensure every item is returned to its rightful owner. The zip tags may be placed on the item in the reverse side of the item where it is not easily visible when wearing the item and if found should be cut off prior to play.

You also agree that no verbal statement made by Horsey Clean a div. of Athletic Clean Corp., employee can be construed as a warranty superseding any statement in this agreement.

  1. Wash Dry and Fold Services

By sending in or bringing in articles of clothing to HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP., for services, also known as equipment by bulk, and or laundry by the pound, you acknowledge that:

There is a ten (10) pound minimum to process a load whether the weight of your order reaches ten

(10) pounds or less. Orders exceeding Ten (10) pounds are charged by the pound at the price on our price list $10/lb. Orders received wet, soaking wet, moist or damp will be weighed as received and processed at the cost per pound per its’ weight when received. As there is an additional cost associated with processing such orders, that cost is factored in by weighing it as it is received.

You also acknowledge that you are responsible for the type of articles you send to be processed in our wash dry and fold service. These articles are not cataloged in our computer system by the piece and are processed by the bulk, we cannot be held responsible for any item damaged in any way as a result of laundering. Items sent to HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP., be processed as wash dry and fold should only be items you would wash and fold at home or at a coin laundry such as, Jerseys, Equestrian socks, compression apparel, specific compression apparel undergarments, t-shits, undergarments, socks, and towels.

HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP., does not provide finishing (ironing), or stain removal in the Wash Dry and Fold service.

  1. Leather Item(s) Processing Consent

Suede and leather garments being made of animal skins, sometimes have inherent defects that may not be apparent before cleaning. In addition to the effects of normal wear, there are other conditions you should be aware of. Some skins may have weak or thin areas that can chafe during processing. Prior exposure to heat and moisture can make skins tender, stiff or brittle. Fading may not be totally corrected by dyeing. Some stains may not be removable. Color uniformity cannot be assured if skins were not originally matched evenly.

You also agree that you have read the foregoing and you release Horsey Clean a div. of Athletic Clean Corp. and its affiliates from responsibility for any of the above conditions.

  1. Repairs/Skate Sharpening/Alteration(s) and or Tailoring Processing Consent

When sending equipment in for Repairs/Skate Sharpening/Alteration(s) and/or Tailoring Process to HORSEY CLEAN A DIV. OF ATHLETIC CLEAN CORP., repair items must be listed for the service to take place by adding the service to the request form. This can be presented in the request form with your bullet points about the item in need of attention coupled with an image upload pointing the area out if the online form is used.

Therefore, you hereby give Horsey Clean a div. of Athletic Clean Corp. your permission to alter your Equestrian equipment/team’s equipment as you’ve indicated. Therefore, you will not hold Horsey Clean a div. of Athletic Clean Corp. and its affiliates responsible for any problems that may occur as a result of these alterations and promise to take full responsibility for any additional costs that may be necessary should your Equestrian equipment/team’s equipment need to be re-altered.

You also understand that no verbal statement made by any Horsey Clean a div. of Athletic Clean Corp. employee can be construed as a warranty superseding any statement in this agreement.

  1. Technical Requirements for Electronic Communications
  2. In order to make EMT payments online or receive Electronic Communications, you must have access to a personal computer with a 128 bit JavaScript enabled browser, internet access and a valid email account supported by software that enables you to receive Electronic Communications. In order to store Electronic Communications on paper, you will need a printer connected to your computer. You also may store them in your offline files or in an electronic storage device. Horsey Clean a div. of Athletic Clean Corp.is not required to provide paper copies of any Electronic Communication you have previously authorized.
  3. You agree to provide us, and keep current, a valid email address.
  4. “Electronic Only” Communications

If you have authorized “Electronic Only” communications, then the following additional terms apply:

  1. You understand and agree that Horsey Clean a div. of Athletic Clean Corp. may provide you with all Electronic Communications exclusively online.
  2. At your request, we will provide you with copies of statements and account information electronically via email or in printed form as requested.
  3. You may elect to withdraw your consent to receive Electronic Communications (other than confirmation of online payments) at any time by communicating with Horsey Clean a div. of Athletic Clean Corp. via email at support@horseyclean.com that you wish to be removed from our email communications.
  4. If you give or withdraw consent by writing to us or calling us, there may be a delay in implementing your request.
  5. You may also contact us if you need to update any information relating to a change in your email address.

 

Governing Law

These terms and conditions will be governed and construed in accordance with the laws of the Province of Ontario (without giving effect to any choice of law principles or rules). The courts located in Toronto, Ontario will have the exclusive jurisdiction for any dispute or legal action brought in connection with these terms and conditions or any services performed by us.

OUR PRIVACY POLICY

We value your personal privacy. We have been doing business since 2007, and we have never sold our Email lists, nor any other client information. This means that information about you such as phone numbers, Email address, postal address, date of birth, and credit card information will be kept totally confidential to the best of our ability.

We are here to provide the best service a business can offer, and would never knowingly betray your trust, which you as our customer have given us. We take industry-standard precautions to protect your data, but it is impossible to guarantee the security of data transmission over the Internet or any wireless network, and so you agree that you use our site and transmit sensitive data to us at your own risk.

Horsey Clean a div. of Athletic Clean Corp. does not sell any information with anyone or any entity what-so-ever. We will transmit information of yours only as necessary to process your order or provide the services to you (for example, we need to send your payment information to our credit card processor, and if you order an item by mail, we would need to provide your address to the shipping agent). All service providers to whom we transmit your information will also be obligated to keep your data confidential.

 

Water Resistant Treatment Services Terms & Conditions

Terms of Use of Horsey Clean Water Repellent Treatment


    1. Horsey Clean Water Repellent Treatment applies a preventive coating designed to protect your horse blankets from weather elements, in particular, rain and snow. We assume no responsibility for water or other damages to your blanket(s), as we have no knowledge of use, wear, age or any of the many contributing factors that contribute to the use and upkeep of a blanket.

    2. The application of Horsey Clean Water Repellent Treatment to your blankets should not void the warranty of the manufacture. Horsey Clean treatments are designed to protect your blanket against short term water exposure (basic seasonal applications is a safe practice). Keeping your blanket maintained is critical to the life span and integrity of the blanket. Washing and drying plays a huge role in this too, however, it does remove some of the coating of treatment over time. Therefore, it is our recommendation to have your blankets water treated at least every three washes minimum and suggest to do it every two cycles. This generally can be timed based on season changes.

    3. We do not warranty that the coating of your blanket will work under all conditions, such as intentional submersion in water, uncharacteristic rainfall or snowfall. We warranty that the coating will be applied to the external side of your blanket in accordance with our product and the external application specifications and that neither the coating material nor the application process will damage your blanket. We are not responsible for any damage that may occur to your blanket, including, but not by way of limitation, through your use or misuse of your blanket.

    4. Water repellent coating should not impact the manufacturers’ warranty. (Please refer to your blanket’s manufacturer’s website for your blanket’s specific Terms & Conditions).

    5. Due to the nature of the process, we are unable to offer any refunds after our Horsey Clean Water Resistant Treatment is applied. In the event of a failed application we will re-apply the treatment to satisfaction and as outlined here in the Water Resistant Treatment Services Terms & Conditions.

Defensive Measures If your horse blankets do become consistently and unusually wet, we suggest that you follow these steps to prevent your blankets from damage or being permanently damaged, even if your blanket is not showing any signs of leakage (after unusual wet weather).  
    • Using S-hooks hang the blanket, so it is off the floor, from the D-rings having it free of anything else to be able to dry on both sides freely. This can be done anywhere you have the space in the barn, garage or basement
 
    • Allow to dry for at least 24-48 hours. This allows any wicking materials to release the moisture and evaporate.
 
    • Hanging the blanket using the D-rings or buckles allows the shape of the blanket to be kept in tact while drying evenly and thoroughly. If you find it is folding inward or on itself, then utilize bungie cords as well to open it up so it is like a sail and the air can move on both side easily.
    Horsey Clean, a division of Athletic Clean Corp., reserves all rights and final decision in the case of a dispute. If you experience or have a concern, please notify us immediately at support@horseyclean.com and we will act accordingly to reach a mutually beneficial end result. The satisfaction of our customers is our greatest intangible asset, however, control of use, duration between treatments, wear and tear must play a factor when determining the application failure and next steps.

Who We Are

Horsey Clean, which trades under the name Athletic Clean Corp. (together with its agents, representatives, consultants, employees, officers, and directors — collectively, “AC”, “HC”, “we”, or “us”) provides equestrian apparel cleaning, processing, repairs and water resistant treatments. We are a Canadian corporation based in Barrie, Ontario, Canada.

How This Policy Applies

This Privacy Policy describes the information we collect from you, how we use that information, and our legal basis for doing so. It also covers whether and how that information may be shared and your rights and choices regarding the information you provide to us.

Your Consent

By using our website, products, or services, you’re acknowledging that you have agreed to our Terms of Service and Acceptable Use Policy, that you have read and understood this Privacy Policy, and that you consent to your information being used for the purposes and for the manner described in this Privacy Policy. For children under the age of 16 to order or use our products or services, a parent or legal guardian must provide the above-mentioned consents on their behalf.

You may withdraw your consent to our management of your personal information, at any time, subject to legal and contractual restrictions, upon reasonable notice. However, such a withdrawal may reduce our ability to provide you with certain products and services. What We Collect and Receive

For you to use our website, products, and services, we need to collect and process certain information. Depending on your use of our website, products, and services, this may include the following types of information.

General personal information

  • Information you provide by completing forms on our website — your name, company name, email and mailing addresses, telephone number, login, and password details. We may ask you for this information if you register for an account on our website, order our products or services, subscribe to our newsletters, login to our online “Client Area” or “Customer Area”, upload or submit content through our website (including the “Client Area” or “Customer Area”), or if you contact us.
  • Information you provide for identity verification purposes when contacting us or for the purposes of processing your payment. In some cases, our payment processor will request that you provide additional personal information to confirm your identity before payment can be processed.
  • For certain domain name products and services, we may request your residency status or whether you are a member of certain organizations. This information is required by certain domain name registries (e.g., Canadian Internet Registration Authority) for the purposes of registering your chosen domain name(s) with the registry.

Payment information

  • Details of any transactions you make through our website, products, or services. As part of a transaction, we may collect and store payment information, including credit card or bank account details (as applicable), expiration date, and country, which we require for payment processing, tax, and regulatory purposes.
  • We partner with other companies (such as PayPal) for payment processing, and the payment information you submit is collected and used by them in accordance with their privacy policies.

  • We use cookies and other technologies (e.g., URL query strings) to help recognize you as a repeat visitor, to process items in your shopping cart, to recognize affiliates, to save your preferences for future visits to our website, and to compile aggregate statistical data about website traffic and interactions (see above), allowing us to provide you with a more friendly and secure user experience.
  • Cookies are stored in your device memory either over the long-term (e.g., to retain your website preferences from visit-to-visit) or as a temporary file which will be cleared from your device memory when you close your internet browser.   • We ask that you do not send or disclose to us any sensitive personal information, including social insurance or social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, criminal background, or trade union membership.

  • User content uploaded, collected, stored, used, transferred, or disclosed in connection with our website, products, or services. Such content includes website and email content in connection with our web hosting, website creation, website security, email solutions and marketing products and services.

How We Use This Information

We use the information we collect from you for the following purposes:

  • To process transactions in connection with our website, products, and services. After a transaction, your personal information (e.g., credit card or financial information) may be kept on file in order to facilitate automated renewals. You may request that your credit card or financial information be deleted from our system and files at any point by contacting us.

Information that is shared publicly

We will not publicly display or reveal to other users your personally identifiable information without your explicit consent, except as described in this Privacy Policy.

When you register for a domain name, we are obligated to transmit certain personal contact information (e.g., your name, address, telephone number, and email address) to the applicable domain name registrar for publication in the publicly accessible WHOIS database. Domain name registrants are required to provide and maintain accurate contact information in the WHOIS database. Unfortunately, as the WHOIS database is publicly accessible, it is a target for data harvesting by persons or organizations engaged in spam, fraud, and identity theft. Consequently, we offer you a Privacy Protection service that will shield your personal information by making us your WHOIS trustee and by listing the contact information of our privacy team instead of your own in the WHOIS database. The Privacy Protection service is available with most domain types during registration or transfer orders, but you may opt out by unselecting the service during the order process. We highly recommend against opting out, but should you do so or should you register a domain type that does not support Privacy Protection, you accept that your personal contact information will be publicly disclosed in the WHOIS database.

We may use certain personal information for promotional purposes (e.g., testimonials on our website). When submitting testimonials through our website or our social media pages you agree that your name, testimonial and website address may be used without additional consent. We will not publicly disclose any of your sensitive information, including your account information, payment information, or personal contact information, without your explicit consent.

Non-personally identifiable visitor and user information may be provided to other parties for marketing, advertising, analytics, or similar purposes.

Information that is not shared publicly

We reserve the right to disclose personal information when we believe that doing so is reasonably necessary to comply with the law or law enforcement, to prevent fraud or abuse, or to protect the rights, property, or safety of WHC, its employees, users, or others.

Our website, products, or services may include links to other websites, products, or services (“External Websites”) whose privacy practices may differ from our own. When you use a link to an External Website, the privacy policy and data processing disclosures for that External Website govern. We assume no responsibility or liability for the interaction with and activities of an External Website. We seek to protect the integrity of our website, products, and services, and the safety of our users. We welcome any feedback that would help us do so, including feedback about External Websites.

Retention

We will retain your information as long as your account is active, as is necessary to provide you with our products or services, or as otherwise set forth in this Privacy Policy.

We may retain backups of your hosting account content for up to 9 months after your hosting service is cancelled or terminated. Backups may be used to restore your data or account in case the data or account is accidentally or maliciously deleted, corrupted, or otherwise damaged. If you wish your information to be deleted prior to the end of the above mentioned period, please contact support@horseyclean.com.

We will also retain and use your information to the extent necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and protect our legal rights.

We also collect and maintain aggregated, anonymized, or pseudonymized information which we may retain indefinitely to protect the safety and security of our website, products, and services, improve them, or comply with legal obligations.

Data Transfers

Your personal information will be collected and stored in Canada, except as otherwise described in this Privacy Policy. However, we work with trusted third-party service providers (e.g., domain name registrars and registries) around the world to provide you with our products and services. Consequently, some of your personal information may be transferred to other countries for processing. We conform to industry standards to help ensure that your privacy is protected and that any transfers of personal information are safeguarded during transit and at the recipient processor.

These third-party countries have their own laws governing data protection and government access to information. The rules that protect your personal information under these laws may be different than in your home country.

If you choose to use our website, products, or services, you must agree to our Terms of Service, which set out the contract between WHC and you. Further, you consent to having the necessary personal information transferred to trusted third-party service providers, located in Canada and other countries, for processing to provide you with the products and services for which you have contracted us.

Your Rights

Users residing in certain countries, including Canada and European Union member states, are afforded certain rights regarding their personal information. Except where an exception or exemption applies, these rights include your ability to access, correct, and request deletion of your personal information. While these rights are not applicable globally, all users of our products or services can manage and revise their personal information in the “Client Area” on our website or by contacting Customer Service. We may request that you provide us with personal information to verify your identity before we can disclose, change, or delete any personal information related to your account.

To modify or delete the personal information you have provided to us, please log in to the “Client Area” or “Customer Area” and update your profile or contact Customer Service.

To request an electronic copy of your personal information, please contact Customer Service.

To delete your account, please contact Customer Service. We may retain certain information as required by law or as necessary for our legitimate business purposes.

Residents of European Union member states have the right to restrict or object to the processing of their personal information under certain circumstances (e.g., to contest the accuracy of the data). Email Notifications

We may send you email regarding your order information, product or service information, company news, promotions, and legal information.

We want to communicate with you only if you want to hear from us. We try to keep emails to a minimum and give you the ability to opt in to any marketing communications we send. You may opt out of receiving marketing email communications by following the detailed unsubscribe instructions located at the bottom of each email or by contacting Customer Service and requesting to opt out.

From time to time, we may provide you with necessary information (e.g., service-related announcements or legal information) to which you will not be able to opt out.

Security

We take security seriously, and the security of your personal information is important to us. We employ a variety of security measures to maintain the safety of your personal information when you place an order with us or access your personal information.

 

  • Your personal information is stored on secure servers or in secure file storage.
  • All sensitive/credit information supplied via our website is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our database, only to be accessed by authorized personnel.

No method of transmission over the internet or electronic storage is completely secure, so we cannot guarantee its absolute security. Your account information is protected by a password, which you should choose carefully and keep secure. If you disclose your password to a third-party, you may lose considerable control over your personal information and you may risk that legally binding actions be taken on your behalf. If the security of your password has been compromised, for whatever reason, you should change it immediately.

Children

You must be 13 years of age or older to register with us. We will not knowingly collect any personal information from children under the age of 13. However, if a child under the age of 13 provides us with personal information, upon written request by a parent or legal guardian, we will delete this information from our files.

If you are under the age of 16, before you may order or use our products or services, your parent or legal guardian must provide written consent on your behalf to our Terms of Service, Acceptable Use Policy, and this Privacy Policy. In particular, your parent or legal guardian must consent to your information being used for the purposes and for the manner described in this Privacy Policy.

Acceptable Use

1. General

Athletic Clean Corp. (hereinafter “AC” or “HC”) employs an Acceptable Use Policy (hereinafter “AUP“) to maintain the integrity and performance of its computer equipment. In a shared web hosting environment, several clients must share limited infrastructure resources. As such, it is important not to use your hosting account in a way that may negatively affect other AC OR HC clients. Our AUP describes what is and is not allowed on our servers. By using any of our services, you agree to comply with our AUP. Failure to comply with the AUP may result in account suspension or termination without prior notice. AC OR HC will remain the sole arbiter in what constitutes a breach of our AUP.

2. Illegal Activities

You may not use any of AC OR HC’s services for illegal purposes. You agree to comply with any applicable local, provincial, federal and international laws, government rules or requirements. You agree you will not be entitled to a refund of any fees paid to AC OR HC if, for any reason, AC OR HC takes corrective action with respect to your improper or illegal use of its services.



AC OR HC reserves the right at all times to disclose any information as AC OR HC deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in AC OR HC’s sole discretion. 3. Spam Policy

AC OR HC has a zero-tolerance spam policy. It is forbidden to send unsolicited mail from or to our servers under any circumstance. Penalties amounting to a minimum of 150.00$, plus taxes, can be charged for a first offence, and penalties double for repeat offenders.

4. Email Delivery

(a) Shared Web Hosting

Shared web hosting or reseller accounts are not designed to be used to send out large quantities of emails simultaneously. There is a limit of how many emails you can send per hour, per account. The number of emails per hour varies based on the plan you select, as described on the AC OR HC website. Emails sent beyond the authorized limit will not be delivered. Mailing lists can have a maximum of 500 recipients. If you do send more than 25 emails at any given time, you must activate a “throttling” feature in your mailing application when sending, so that every delivery is delayed by a minimum of 10 seconds so as not to overcharge the server. You may not attempt to circumvent this limit by linking multiple hosting accounts together. If you would like to send larger quantities of legitimate commercial emails, please inquire with our sales team about our commercial Email Marketing service.

You may not send emails with attachments greater than 20 MB from AC or HC Users. If you need to share larger files, you are encouraged to upload your files on your hosting account and email a hyperlink (“URL”) to the file.

Each mail box must not exceed 2GB in total size. Clients are encouraged to download or archive their emails on a regular basis using software such as Microsoft Outlook, Apple Mail, or Thunderbird using the POP3 protocol, and deleting read emails from the server.

(b) Dedicated Servers and VPS

There is no fixed email delivery limit; however, a $150 administrative fee will be charged to your account if your public IP address gets listed in a public “blacklist” and we need to actively intervene in order to get it de-listed.

5. Backups

(a) Shared Web Hosting

Shared web hosting accounts may not use their disk space for backup storage, or storage of any files not directly linked from their web sites. You may store a maximum of 1 backup of your web hosting account on the server at any given time, and for a period not exceeding 24 hours. Please do not make backup copies of your backups.

If needed, backup copies can be generated by the Client during off-peak hours, from midnight to 5AM EST. It is strictly forbidden to generate backups of your account between 5AM and 11:59PM EST, as this can seriously degrade the system’s performance. This applies to backups generated from the cPanel, or any other type of automated backup such as those performed by third-party services and automated plugins.

AC OR HC regularly backs up most AC or HC Users on its servers, as described on the AC OR HC Web Site. Due to the resource-intensive nature of the backup process, AC OR HC cannot guarantee the regular and consistent back up and/or restore of accounts that exceed 20 giga-bytes (“GB”) of total data or more than 200,000 files (including emails, databases, regular files, statistics, and configuration files). Accounts that store more than 20 GB of data or more than 200,000 files risk no longer being backed up automatically. Manual backups will still be possible in most situations. To re-activate automatic backups, the Client must bring the total amount of data stored on their account to less than 20 GB of data and less than 200,000 files and contact our support department. Files exceeding 1 GB will not be included in the regular backups.

(b) Dedicated Servers and VPS

Dedicated server clients are responsible for backing up their own data. Upon request, a managed backup service can be provided at additional cost.

6. Resource Usage

(a) Shared Web Hosting

In order to guarantee reliable service, AC or HC Users may not use more resources than what would be required by a regular web site in the course of its regular activities. Accounts may not use more than 5% of the total AC OR HC system resources for a period longer than 60 seconds. This includes CPU cycles, RAM usage, disk space, and bandwidth. Accounts found to be exceeding the allowed resource usage may be suspended without prior notice in order to prevent serious service degradation. AC OR HC will attempt to notify the client whenever possible and work with them to resolve any resource usage problem. Often, these types of problems may be resolved by repairing a faulty script, disabling a resource-intensive application, or banning malicious IP addresses from your account. Clients consistently using excessive resources may be required to transfer their account on a separate dedicated or private server, where resource usage limits are not imposed.

AC OR HC server resources cannot be used for any other purpose than to serve data from your web sites. Under no circumstance can the server resources be resold, or used for data processing outside of the context of serving web pages or other web-accessible content to your site’s visitors.

Please note that a shared hosting environment is not intended for extremely resource-intensive sites. In these cases, custom dedicated server solutions or virtual private servers are recommended.

(b) Dedicated Servers and VPS

Dedicated servers are permitted to use the full resources available on their machine.

7. Disk Space Usage

(a) Shared Web Hosting

While we don’t impose fixed disk space limits, in order to protect our clients from users consuming an excessive amount of resources, we have established the following rules concerning the use of disk space on AC or HC Users:

  • You may not use your web hosting space to store files that are not directly related to your web site, and that are not linked to directly from at least one section of your web site.
  • You may not store more than 5,000 immediate files in any given folder (or directory), or more than the total files (inodes) allowed by your hosting account, as follows:
    • Starter web hosting: 100,000 inodes
    • Pro web hosting: 200,000 inodes
    • Enterprise web hosting: 300,000 inodes
  • You may not sell or offer free disk storage on our servers to third parties, outside of the context of our Reseller services.
  • You may not increase your actual disk space usage by more than 10 GB in a 24-hour period without prior written notice.

(b) Dedicated Servers

Clients are permitted to use the full hard drive space available on their machine.

(c) Cloud Servers

Cloud servers can not contain more than 1,000,000 inodes in order to ensure system stability and performance. If you require more than 1,000,000 inodes, please consider purchasing a Dedicated Server by contacting AC OR HC.

8. Processes

(a) Shared Web Hosting

All processes invoked by the web server, cron, shell or other should not exceed the following limits:

  • Open more than 64 files simultaneously;
  • Create core dumps;
  • Be executed continuously as a background process;
  • Execute more than 5 threads or sub-processes simultaneously;
  • Execute more than 5 consecutive URL rewrite rules.
  • Be executed for a period longer than 60 consecutive seconds

(b) Dedicated Servers

Dedicated are not limited by the number of simultaneous processes they can run.

(c) Cloud Servers

May not use more than 30% of total system resources for longer than 60 continuous seconds to avoid serious service degradation.

9. Databases

(a) Shared Web Hosting

  • Database users are limited to 30 simultaneous connections.
  • Databases are limited to a maximum size of 1 GB and 1,000,000 records each.
  • The total number of database requests should not exceed 5,000 per hour.
  • Remote database access is only allowed for administrative purposes. It is forbidden to use databases hosted on AC OR HC servers in conjunction with scripts hosted elsewhere.

(b) Dedicated Servers and VPS

There are no database limitations on Dedicated and VPS clients.

10. Allowed Software and Scripts

All software and scripts installed on your account must be free of vulnerabilities, viruses, and malware. Any software having vulnerabilities documented on the Internet is strictly forbidden on our servers. It is your responsibility to update all the installed software with the latest security patches in a timely manner. On Shared Web Hosting servers, AC OR HC provides automatic installation tools that can also handle automatic software updates shortly after updates are released by the vendors. However, it is ultimately solely your responsibility to maintain up-to-date versions of your software on your account.

Popular web applications such as WordPress, Drupal, Joomla, phpBB, along with their plug-ins, modules, and add-ons, are particularly vulnerable to exploits due to their popularity, so additional vigilance must be used to ensure the software is safe and up-to-date.

Insecure scripts and software may be disabled by AC OR HC at any time without prior notice to prevent issues with the server’s security.

11. Unlawful Conduct or Improper Use

You agree not to use AC OR HC systems for any purpose that is unlawful or prohibited by this AUP, and you agree to comply with any applicable local, provincial, federal and international laws, government rules or requirements.

AC OR HC reserves the right to terminate services, in its sole discretion, if you are using the services, in association with spam or morally objectionable activities including, but not limited to:

  1. Activities designed to defame, embarrass, harm, abuse, threaten, slander or harass third parties;
  2. Transmission, distribution or storage of any material in violation of any applicable law or regulation, including Warez and any pirated content or tools;
  3. Transmission, distribution or storage of any material protected by copyright, trademark, trade secret or other intellectual property right without proper authorization, and material that is obscene, defamatory, an invasion of privacy or constitutes an illegal threat, or is otherwise illegal;
  4. Misrepresenting or fraudulently representing products/services;
  5. Impersonating the identity of a third party;
  6. Illegal access to other computers or network (i.e. hacking) and distribution of Internet viruses or similar destructive activities;
  7. Violating Canadian or American export control laws for software or technical information;
  8. Facilitating, aiding, or encouraging any of the above activities, whether using AC OR HC’s network or service by itself or via a third party’s network or service;
  9. Interference with a third party’s use of AC OR HC’s network or service, or ability to connect to the Internet or provide services to Internet users.

The following uses of our servers are strictly forbidden:

  1. Proxy servers;
  2. Auto-surf sites;
  3. IRC Servers.

12. Adult Content

Explicit or pornographic content is strictly forbidden from AC or HC Users. Legal adult content is permitted on Dedicated or VPS servers.

13. Shell Access

Shell access is disabled by default on AC or HC Users, but may be enabled by submitting a request via our helpdesk. The “find” Unix command may not be used on a directory having more than 5 levels of sub-directories.

Dedicated Servers are granted complete Shell Access.

14. Downloads

You may not offer downloads of third-party software (i.e. software, games, or tools that were not directly created by you or for which you do not have an exclusive distribution agreement) from your hosting account. These are commonly referred to as “mirror” download sites. Instead, you are encouraged to link to the vendor’s original download site.

15. Chat Software

Due to the resource-intensive nature of these programs, you may not install and use real-time chat software on AC or HC Users, unless this software was provided by us.

16. Cron Jobs

AC or HC Users: Cron jobs must not be scheduled more often than once every 10 minutes. Two or more separate Cron jobs may not be executed at the same time; a minimum of 5 minutes should separate two scheduled executions. You may not schedule a total of more than 5 cron jobs on any hosting account.

There are no cron job limitations on Dedicated Server and VPS.

17. Violation

AC OR HC will, at its own discretion, determine what action will be taken in case of a violation of the AUP. AC OR HC reserves the right to suspend or terminate any account found to be violating the AUP without notice and without refund of any pre-paid fees. Violation of this AUP could also subject you to criminal or civil liability.

18. Rights reserve

AC OR HC reserves the right to modify this AUP at any time without providing prior notice. You are responsible for all use of the AC OR HC services by yourself, your employees, agents, contractors, invitees and customers, whether such use is with or without your consent.

19. Questions and Concerns

20. How to Report Abuse

Please contact abuse@AC or HC.ca or open a ticket in our helpdesk. Please ensure you include as much information as you can to assist our investigations. Complaints will be investigated within 24 hours of receipt and we may follow up to obtain additional information. Unless we require additional information, you will not receive a reply or update from us.

22. Severability

Should any provision of these Terms and Conditions be contrary to law, void, enforceable or illegal for any reason, such provision shall be deemed severable from the Terms and Conditions and shall not affect the validity or the enforceability of the remaining provisions.

23. Applicable Law and Jurisdiction

This Agreement and its interpretation are subject to the laws of the province of Ontario and the laws of Canada applicable therein, without giving effect to any principles of conflicts of laws. The Parties must irrevocably submit all disputes arising out of this Agreement to the courts of the Province of Ontario, including disputes regarding the Agreement’s interpretation and its effects.
